1. About getNgigs

getNgigs is a marketplace platform connecting independent musicians with venues, festivals, and private event hosts. We provide tools for artists to create professional booking profiles, pitch venues, plan tours, and find performance opportunities. getNgigs facilitates connections only — we do not manage, book, employ, or represent any artist or venue.

2. Eligibility

You must be at least 18 years old to create an account. By registering you represent that you are 18 or older and that all information you provide is accurate and complete.

3. Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

We reserve the right to suspend or revoke access for violations of these Terms.

4. Pro Membership

Certain features are available only to Pro members, including unlimited venue pitching, access to private event host contact details, and SMS booking notifications. Pro status is granted at registration or by administrator action. Pricing and Pro features may change with notice.

5. Artist Profiles and Content

You retain ownership of content you submit to the platform including profile photos, bios, audio samples, and videos. By submitting content you grant getNgigs a non-exclusive license to display that content on the platform.

You are solely responsible for the accuracy of your profile and booking information. Do not impersonate another artist or submit false information.

6. Marketplace — No Agency Relationship

getNgigs is a neutral marketplace. We are not an agent, representative, employer, or guarantor of any artist or venue on the platform. We do not participate in, oversee, or guarantee any booking, performance, payment, or contract made between users.

All bookings, agreements, and payments are made directly and exclusively between the artist and the venue or event host. getNgigs has no involvement in and accepts no liability for the terms, fulfillment, or outcome of any such agreement.

You acknowledge that getNgigs does not screen, verify, background-check, or certify any user on the platform. You are solely responsible for conducting your own due diligence before entering into any agreement with another user.

7. User Interactions — Assumption of Risk

By using the platform you expressly acknowledge and agree that any interaction with another user — including but not limited to messaging, pitching, booking negotiations, performances, and payments — is undertaken entirely at your own risk.

getNgigs shall not be responsible or liable for any loss, damage, injury, or harm of any kind resulting from interactions between users, including but not limited to: non-payment, non-performance, cancellations, no-shows, property damage, personal injury, fraud, misrepresentation, harassment, or breach of any agreement between users.

If you have a dispute with another user, you agree to resolve it directly with that user. You release getNgigs and its officers, employees, and agents from any claims, demands, and damages arising out of or in connection with such disputes.

8. Private Events Board

Public users may submit private event listings without creating an account. By submitting a listing you confirm that the event is genuine and that you have authority to seek entertainment for it. Your email address will be shared with Pro artists who respond to your listing. getNgigs is not responsible for any arrangements made between event hosts and artists.

We reserve the right to remove any listing that violates these Terms or that we determine is inappropriate, fraudulent, or spam.

9. SMS Notifications

Pro artists and venue owners may opt in to receive SMS notifications. By opting in you consent to receive automated text messages from getNgigs at the phone number provided. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time. Reply HELP for assistance. For support contact [email protected].

10. Prohibited Conduct

You agree not to:

• Submit false, misleading, or fraudulent information
• Harass, spam, or send unsolicited messages to venues or artists
• Scrape, copy, or redistribute platform data without permission
• Attempt to circumvent platform security or access controls
• Use the platform to advertise services unrelated to live music performance
• Violate any applicable law or regulation
• Use another user's contact information obtained through the platform for any purpose other than booking-related communication

11. Intellectual Property

The getNgigs name, logo, and platform design are owned by getNgigs. You may not use our trademarks or reproduce platform content without our written permission.

12. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We make no representations regarding the accuracy of venue or artist information, the availability of booking opportunities, or the conduct of any user. We do not guarantee that the platform will be uninterrupted, error-free, or that any particular booking outcome will result from using it.

13. Limitation of Liability

To the fullest extent permitted by applicable law, getNgigs and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the platform, including but not limited to: lost bookings, lost revenue, reputational harm, personal injury, property damage, or disputes between artists and venues or event hosts.

In no event shall getNgigs's total liability to you for all claims exceed the amount you paid to getNgigs in the twelve months preceding the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless getNgigs and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the platform, your content, your interactions with other users, or your violation of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the platform after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.
